Denver – Depart of Justice will petition the Supreme Court to uphold a law that makes it illegal to falsely claim being a war hero.
The law, the Stolen Valor Act, may be appealed by Government lawyers in a court filing on Thursday in California. California is one of two states that has challenged the act.
This appeal wasn’t expected. Prosecutors have until Aug. 18th to formally act.
Last August ,the 9th U.S. Circuit Court of Appeals in San Francisco ruled the law violated the First Amendment. The law is also under review by the 10th Circuit in Denver after a lower court deemed it unconstitutional for the same reasons.
The law makes it illegal to lie about being a war hero and receiving a military medal.
